Terms and Conditions
for Sakura Bonsai

This document sets out the terms and conditions (“T&C”) for the use of the website sakurabonsai.ro and the conditions of distance contracts concluded with BOLDSAI GRUP SRL, as the merchant.

The website sakurabonsai.ro (the “Website”) is operated by BOLDSAI GRUP SRL (“Sakura Bonsai”, the “Provider”).
2. Acceptance of the Terms
Accessing the Website, creating an account, placing an order or using any functionalities constitutes acceptance of these T&C. We may update the T&C; the new version applies only to orders placed after publication.
3. User account
- By creating an account, you declare that you are at least 18 years old and that the information provided is true, current and complete.
- You are responsible for the confidentiality of your credentials and the activity carried out in the account.
- We may suspend/close accounts in cases of fraud, abuse or breach of the T&C.
4. Products, images and stock
- Photos are illustrative; in particular, live plants may present natural variations in shape, color, size or crown density compared to the images.
- Stocks and prices may be updated without prior notice until the order is confirmed.
- For live plants we may indicate, where applicable, care recommendations; these are for information purposes only.
5. Prices, taxes and payment methods
- Prices are expressed in RON and include VAT, unless otherwise stated on the product page.
- Available payment methods:
- Online card (Stripe) – secure processing;
- Cash on delivery (if available in the recipient’s location);
- Bank transfer (payment order).
- The order is accepted upon issuance of the e-mail confirmation and/or the invoice.
- For payments by bank transfer/cash on delivery there may be third-party fees (banks/couriers) that do not depend on us.
6. Delivery
- Delivery is carried out via Cargus and Fan Courier (or, occasionally, equivalent partners).
- The timeframe shown at checkout is indicative; delays may occur due to factors beyond our control (weather conditions, traffic, peak periods).
- Upon receipt, please check the integrity of the parcel. If you notice visible damage, ask the courier to draw up a report and contact us immediately.
- We deliver within Romania. Delivery to other countries is made only if expressly specified on the Website.
7. Specifics for live plants
- Plants are living organisms, sensitive to temperature, light and handling. We recommend prompt collection of the parcel and acclimatization according to the instructions.
- Any obvious non-conformity (severe damage/plant dead on arrival) must be reported within 48 hours from delivery, with photos/videos of the packaging and the plant.
8. Right of withdrawal and return policy
8.1. Legal framework
Consumers (natural persons) generally benefit from 14 days to withdraw from distance contracts. However, there are exceptions provided by law (e.g., products liable to deteriorate or expire rapidly).
8.2. Live plants (and bundled products that include plants)
- For plants and bundled products that include plants (e.g., “bonsai + pot”), the 14-day legal right of withdrawal does not apply, as these are products liable to deteriorate rapidly.
- Sakura Bonsai commercial policy: we accept notifications and returns within 48 hours from delivery for plants/bundled products only if there is an obvious non-conformity upon receipt (e.g., compromised plants, major quality defects). Return is approved based on photo/video evidence and our assessment. In the absence of non-conformity, returns for plants are not possible.
8.3. Pots and accessories sold separately (without a plant)
- The legal right of withdrawal of 14 days applies.
- The product must be returned in the condition in which it was delivered, with all accessories/documents.
- If the pot has been used with soil/plants, the 14-day return remains possible, but we reserve the right to retain a value reduction (cleaning, signs of use, etc.), proportionate and justified.
8.4. Withdrawal/return procedure
- Notify withdrawal within 14 days from delivery (or within 48h for plants). You may use the standard withdrawal form or write to us at office@sakurabonsai.ro.
- Returns are shipped to the address indicated by us; the return cost is generally borne by the consumer (subject to legal exceptions or unless otherwise agreed).
- Refund is made within no more than 14 days from receiving the notice, but we may delay the refund until receipt of the goods or proof of shipment. Refunds are made via the same payment method, unless otherwise agreed.
9. Legal guarantee of conformity (non-perishable goods)
- Non-perishable products (e.g., pots, tools) benefit from the legal guarantee of conformity provided by law.
- The guarantee covers lack of conformity existing at delivery and is exercised within the applicable legal term. Remedy is by bringing into conformity, proportionate price reduction, or termination of the contract, as applicable.
10. Complaints and dispute resolution

- You may use Alternative Dispute Resolution (ADR) via the ANPC platform: https://reclamatiisal.anpc.ro/.
- Note: The European ODR platform was closed on 20 July 2025; for cross-border complaints, follow the guidance on the “Consumer Redress in the EU” website.
11. Data protection
We process personal data in accordance with the GDPR and national legislation. Full details are available in the Privacy Policy (separate document available on the Website).
12. Cookies
The Website uses cookies. For details on types, purposes, lifespan and consent, see the Cookie Policy (separate document).
13. Intellectual property
The Website content (texts, images, logos, design) belongs to Sakura Bonsai or its partners and is protected by copyright and trademark laws. Any use without our consent is prohibited.
14. Limitation of liability
To the extent permitted by law, we are not liable for indirect losses (loss of profit/opportunities). Consumers’ statutory rights are not affected.
15. Force majeure
No party is liable for non-performance caused by force majeure/act of God. Affected obligations are suspended for the duration of the force majeure event.
16. Governing law and jurisdiction
The T&C and distance contracts concluded through the Website are governed by Romanian law. Disputes not resolved amicably will be settled by the competent courts of Romania.
